  5. License Agreement

  7. You should carefully read the following terms and conditions
  8. before using this software.  Unless you have a different license
  9. agreement signed by J Technology, Inc. your use of this
  10. software you indicates your acceptance of this license agreement
  11. and warranty.

  13. Shareware Version

  15. Evaluation and Registration
  16.  
  17. This is not free software.  You are hereby licensed to use this
  18. software for evaluation purposes without charge for a period of 30
  19. days or 15 Times which ever comes first.  If you use this software 
  20. after the 30 day evaluation period a registration fee of $23 is required.  
  21. Payments must be in US dollars drawn on a US bank, and should be sent to 
  22. J Technology, Inc., P.O. Box 749, Athens, Al 35612.  Credit card ordering 
  23. and quantity discounts are available, as described in the section Ordering 
  24. Information/Order Form.  When payment is received you will be sent a Activation Key  
  25. along with information on how to obtain the latest version of FTP Icon Connection.

  27. Unregistered use of FTP Icon Connection after the 30-day evaluation period is
  28. in violation of U.S. and international copyright laws.

  30. Distribution

  32. Provided that you verify that you are distributing the Shareware
  33. Version you are hereby licensed to make as many copies of the Shareware version of
  34. this software and documentation as you wish; give exact copies of
  35. the original Shareware version to anyone; and distribute the
  36. Shareware version of the software and documentation in its
  37. unmodified form via electronic means.  There is no charge for any
  38. of the above.

  40. You are specifically prohibited from charging, or requesting
  41. donations, for any such copies, however made; and from
  42. distributing the software and/or documentation with other products
  43. (commercial or otherwise) without prior written permission, with
  44. one exception:  Disk Vendors approved by the Association of
  45. Shareware Professionals are permitted to redistribute FTP Icon Connection,
  46. subject to the conditions in this license, without specific
  47. written permission.

  49. Registered Version

  51. One registered copy of FTP Icon Connection may either be used by a single
  52. person who uses the software personally on one or more computers,
  53. or installed on a single workstation used nonsimultaneously by
  54. multiple people, but not both.

  56. You may access the registered version of FTPic through a network,
  57. provided that you have obtained individual licenses for the
  58. software covering all workstations that will access the software
  59. through the network.  For instance, if 8 different workstations
  60. will access FTPic on the network, each workstation must have its
  61. own FTPic license, regardless of whether they use FTPic at
  62. different times or concurrently.

  66. This agreement shall be governed by the laws of the State of
  67. Alabama

  69. Disclaimer of Warranty

  71. THIS SOFTWARE AND THE ACCOMPANYING FILES ARE SOLD "AS IS" AND
  72. WITHOUT WARRANTIES AS TO PERFORMANCE OF MERCHANTABILITY OR ANY
  73. OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED.  In particular,
  74. there is no warranty for the optional virus scanning feature
  75. (FTPic v2.0 does not scan for viruses).  Because of the
  76. various hardware and software environments into which FTPic may
  77. be put, NO WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE IS
  78. OFFERED.

  80. Good data processing procedure dictates that any program be
  81. thoroughly tested with non-critical data before relying on it.
  82. The user must assume the entire risk of using the program.  ANY
  83. LIABILITY OF THE SELLER WILL BE LIMITED EXCLUSIVELY TO PRODUCT
  84. REPLACEMENT OR REFUND OF PURCHASE PRICE.
